Legal launch advisory

Forex Brokerage Incorporation & Regulatory Licensing

A brokerage launch needs two separate decisions: where to incorporate the operating company, and what activity approvals are required for the products, clients and regions you intend to serve. We coordinate a document-led workstream with registered agents and independent counsel; we do not issue financial licences or guarantee approvals.

Regulatory and pricing note. Registering a company does not itself authorise forex/CFD trading, holding client money, investment advice or solicitation in another market. We are a technology implementation provider, not a regulator or licensed brokerage.

Detailed package comparison

Compare packages, scope, included documents and exclusions

Compare real brokerage licence categories, corporate formation jurisdictions, first-year and annual costs, banking, genuine premises and MT5/CRM infrastructure. Our aim is a procurement-ready decision, not another generic list of countries.

Comparison figures are third-party publicly displayed prices observed on 26 October 2026, not MT5 Broker Setup's confirmed selling prices or statutory regulator invoices. Inclusions, tax, applicability, currency and service availability must be validated in a current written proposal.

Who is this service suitable for?

Business models, ideal uses and important boundaries

Founder creating first FX/CFD brokerage

Choose legal activity first, then financing and platform; do not buy an offshore registration as a shortcut.

Prop firm/challenge platform

Analyse simulated versus live accounts, payouts, customers and payment/consumer law.

Existing unregulated offshore operator

Audit old entity/licence claims, bank onboarding risks and possible compliant alternatives.

Forex CRM and software vendor

Company formation for B2B software can be distinct from regulated dealing.

Introducing broker / marketing partner

Client referral compensation and financial promotion law need target-country checks.

Multi-jurisdiction group expansion

Entity, capital, licence, privacy and tax obligations often multiply with client geography.

Implementation stages

Process, documentation and handover

Choose target-client countries and legal entity model

Real implementation checklist

From initial assessment to verified handover

The milestones below describe what needs to be verified by the appropriate registered agent, legal adviser, authority, bank or platform provider before declaring the work complete.

1

Define regulated business and actual customers

Use a jurisdiction/product/flow matrix to determine licences before selecting a cheap entity.

2

Shortlist viable legal structures

Compare available corporate registries and financial supervisors separately.

3

Get line-item provider proposals

Ask for verified authority tariffs, legal services, capital, office, initial and annual charges.

4

Submit correct documents through eligible professionals

Owners, directors, capital, business plans, policies and filings by authorised local parties.

5

Verify issuance and implement controls

Authentic corporate documents, actual licence conditions, platform/CRM integration and bank acceptance.

6

Launch and maintain a compliance calendar

Target market permission, tax, renewal, reports, customer complaints, incident readiness and licence changes.

Existing companies and ongoing service

Transfers, amendments and continuing support

Existing brokerage and legal migration

Review client contracts, accounts, licence conditions and consent rather than assuming a licence transfer.

Existing corporate agent transfer

Obtain standing, incumbent agent releases, accounting records and current fees.

IT and data platform migration

Verify lawful data ownership, trading history, privacy and third-party software contracts.

Operational risk after restructuring

Bank/PSP reviews, client communication, responsible officers and regulator notifications.

Frequently asked questions

Does incorporation make a forex broker regulated?

No. Company registration establishes an entity; forex dealing, advising, marketing or client-money activities may need separate permissions, often in each target market.

Are regulator approvals guaranteed?

No. The relevant authority decides whether to accept, reject or request more evidence.

Does the proposed budget include MT5 platform rights?

No unless explicitly itemised. A genuine MetaQuotes licence and integrations need separate rights and agreements.

What does the starting price on the legal hub actually mean?

It identifies published third-party package examples, not a signed Fin Node offer. Government fees, legal expenses and capital may be separate.

Which countries issue recognised forex brokerage licences?

Permissions depend on the exact instruments and activities. Mauritius FSC has investment dealer categories; Labuan FSA defines non-principal money broking; other structures vary.

Why is Saint Lucia labelled incorporation-only?

The Saint Lucia FSRA officially warned on 15 April 2025 that it does not license forex business there.

Can an Anjouan licence guarantee global access?

No. The Union of Comoros Ministry of Finance warned of fraudulent forex/crypto licence issuance in December 2025; evaluate national and customer-country laws.

Can I start marketing and collect deposits while applying?

Not solely because you submitted an application or incorporated a company. Only begin regulated activity when actual relevant permissions and conditions are satisfied.

What does MT5 Broker Setup sell in this workstream?

Technology and implementation planning, document-readiness, and professional introductions within written scope. We are not a financial regulator or licence issuer.
